Rule Transfer

Through the enactment of House Bill 5, 85th Legislature, R.S. (2017), the Texas Department of Family and Protective Services (DFPS) became a stand-alone agency on September 1, 2017, that is separate from the Texas Health and Human Services Commission (HHSC). As a result, some functions and programs provided by DFPS are now being provided by HHSC and there have been changes to the organizational structure of DFPS. Accordingly, the regulatory functions of DFPS' Child Care Licensing (CCL) have transferred to HHSC while CCL staff who investigate abuse and neglect remain at DFPS but now under a new Investigations division. Due to the restructuring of DFPS' Child Care Licensing division, DFPS' licensing rules in Title 40, Part 19, Chapter 745, Subchapter O, concerning Independent Court-Ordered Adoption Evaluations will be transferred and reorganized under Title 40, Part 19, new Chapter 735.

The rules will be transferred in the Texas Administrative Code effective May 1, 2018.
