SUBCHAPTER G. VOLUNTEER AND COMMUNITY ENGAGEMENT

The Executive Commissioner of the Texas Health and Human Services Commission (HHSC), on behalf of the Department of State Health Services (DSHS), adopts amendments to §417.301, concerning Purpose; §417.303, concerning Definitions; §417.305, concerning Limitations on Private Donations; and §417.306, concerning Volunteer Services Council; adopts new §417.302, concerning Application; and adopts the repeal of §417.302, concerning Application; §417.304, concerning Volunteers and Donors; and §417.308, concerning Department Policies. The amendments, repeals, and new rule are adopted without changes to the proposed text as published in the September 14, 2018, issue of the Texas Register (43 TexReg 5922). Therefore, the rules will not be republished.

BACKGROUND AND JUSTIFICATION

The amendments, repeals, and new rule update DSHS procedures and practices for volunteer programs associated with the Texas Center for Infectious Disease or other DSHS facilities, and donations made by private individuals to DSHS facilities and individuals served at DSHS facilities. The rules remove references to HHSC facilities, update references to DSHS organizational units, and clarify procedures and practices. HHSC is adopting new rules in Texas Administrative Code, Title 26, Chapter 901 to address volunteer programs and donations at HHSC facilities.

COMMENTS

The 30-day comment period ended October 15, 2018. During this period, DSHS did not receive any comments regarding the proposed rules.

STATUTORY AUTHORITY

The amendments and new rule are authorized under Texas Government Code, §531.0055, and Texas Health and Safety Code, §1001.075, which authorize the Executive Commissioner of HHSC to adopt rules and policies necessary for the operation and provision of health and human services by DSHS and for the administration of Texas Health and Safety Code, Chapter 1001; Texas Government Code, Chapter 2109, which governs volunteer programs in a state agency; and Texas Government Code, Chapter 2255, concerning the relationship of a state agency to a private donor or a private organization.

The agency certifies that legal counsel has reviewed the adoption and found it to be a valid exercise of the agency's legal authority.
