PLAN FOR REVIEW OF AGENCY RULES FOR FISCAL YEARS 2004 - 2007

Pursuant to the Administrative Procedure Act (APA), Texas Government Code §2001.039, Agency Review of Existing Rules, the Public Utility Commission of Texas (commission) files the following plan with the Secretary of State for the review of all commission rules for the fiscal years between September 1, 2003 and August 31, 2007. Project Number 27816, Review of Agency Rules Pursuant to the Administrative Procedure Act 2001.039 for FY 2004 - 2007 is assigned to this review plan.

The commission's existing rules may be found on the agency's website at http://www.puc.state.tx.us or in the Texas Administrative Code (TAC) at:

16 TAC Chapter 22, Practice and Procedure;

16 TAC Chapter 25, Substantive Rules Applicable to Electric Service Providers;

16 TAC Chapter 26, Substantive Rules Applicable to Telecommunications Service Providers; and

16 TAC Chapter 27, Rules for Administrative Services.

The commission will initiate a new project each fiscal year for the review of the chapter scheduled for that year. Actions to amend, repeal, or adopt rules may begin independently of this schedule if required by legislative action, court decision, commission decision, or other causes. In those instances, reasonable opportunity for comments will be provided pursuant to APA 2001.029.
